Montana

The Statute

Title 16, Chapter 1, Part 2, § 16-1-201 provides for "acts not covered" under the Montana Alcoholic Beverage Code. Section 16-1-201(1) permits any brewer duly licensed under federal statute to manufacture alcoholic beverages (beer) pursuit to such federal statute.

Summary

Section 16-1-201(1) provides a simple provision allowing home production of beer.  Activities must fall within the federal statute for the production of beer for family use.  The one special provision, you are restricted to alcohol content of no more then 7% ABV.
North Dakota

The Statute

Title 5, Chapter 5-01, § 5-01-04 permits the manufacture of malt beverages and wine for personal or family use.

Summary

Section 5-01-04 allows exceptions to title 5.  It allows the home production of beer subject to federal limits.
South Dakota

The Statute

Title 35 Chapter 1, Article 1, §35-1-1.8 defines Malt Beverage as a beverage made by the alcoholic fermentation of an infusion or decoction, or combination of both, in potable brewing water, of malted barley with hops, or their parts, or their products, and with or without other malted cereals, and with or without the addition of unmalted or prepared cereals, other carbohydrates or products prepared therefrom, and with or without the addition of carbon dioxide, and with or without other wholesome products suitable for human consumption containing not less than one-half of one percent of alcohol by weight. South Dakota Title 35 Chapter 1, Article 5, §35-1-5.4 permits an individual to produce for personal, family, or similar use two hundred gallons or less of malt beverage each year.

Summary

§35-1-5.4 enables the manufacture of malt beverages (beer) for personal use. No license, tax, or fee is required to make malt beverages unless production is over 200 gallons.
Wyoming

Statute

Title 12, Chapter 1, § 12-1-101(x) defines a Malt beverage as any fluid, substance or compound intended for beverage purposes manufactured from malt, wholly or in part, or from an substitute therefor, containing at least one-half of one percent (.5%) of alcohol by volume. Wyoming statute Title 12, Chapter 8, § 12-8-102 provides that any person may manufacture fermented or malt beverages in limited quantities for his sole personal consumption.

Summary

§ 12-8-102(a) is the statute enabling the manufacture of malt beverages for personal consumption.  Anyone selling or manufacturing illegally is subject to a minimum $1,000 fine, one year in jail or both!
